A sidebar in Mark Golden's article in the same issue quotes G. Burgess Allison:

"The stability of your ASP is crucial, as is the need for some kind of offline what-if-they-go-out-of-business backup policies. Any law firm that simply hands over its records-lock, stock and green eyeshades-to some dot-com whose business model is selling eyeballs is asking for trouble. It would be like handing over your accounting records to some accountant you shouldn't trust (like Fred's Fly-By-Night Recordkeeping and Bail Bonds). Accounting and recordkeeping have risks-regardless of whether you use an ASP or some human who comes to your office and hands you checks to sign. Both are suppliers who can go out of business, and who can get you in trouble if they do.
"Like any technology, the ASP is dangerous mostly when people treat it like a panacea-like something that absolves them of the responsibility to do due diligence on their selection. An ASP is not more likely to go out of business than an 'in-person' service. It's just that it's new and people tend to say, 'Oh, I didn't think about that.'"
